Zakir Naik: Apologise or get sued

PUCHONG: Dr Zakir Naik had yesterday filed suits against Human Resources Minister M Kula Segaran, Klang MP Charles Santiago and Bagan Dalam assemblyman Satees Muniandy each for defamation.
The suit was filed at the Kuala Lumpur High Court by the firm of Messrs Akberdin and Co after Letter of Demand was served on them earlier.
Santiago was served the suit yesterday while Kula and Satees are expected to received them today.
The Indian-born preacher, who is a Malaysian permanent resident, gave the DAP lawmaker 48 hours to retract his remarks, failing which, legal action would be initiated against the latter.
The notice, sent through legal firm Messrs Akberdin & Co, demanded Charles to:
- Admit liability and retract the allegations
- Immediately remove all defamatory, spurious, untrue and/or fallacious allegations, accusations and/or remarks against Zakir especially from all social media and/or websites
- Immediately cease and desist from publishing and/or causing to be published all and/ or any defamatory, spurious, untrue and/or fallacious allegations, accusations against Zakir
- Within 48 hours of the date of receipt of this letter, publish and/or cause to be published an unreserved apology which is to be posted, uploaded and/or published on your social media and/or websites.
- Within 48 hours of the date of receipt of this letter, make an offer of a reasonable sum of settlement to Zakir for the damage, embarrassment, humiliation and/or dishonour caused to him as a result of the said defamatory statements.
According to the notice, Santiago was accused of making the defamatory statements during a talk on in Kuala Lumpur on Nov 25.
It added that the remarks were subsequently reported by a news portal with the headline, “Criticism of Zakir may have led to LTTE arrests.”
According to the legal notice, Santiago’s remarks, which claimed the 12 were arrested under the Security Offences (Special Measures) Act 2012 (Sosma) in retaliation to the criticisms against Zakir, were motivated by malice and hatred.
The remarks, which the letter described as fictitious, is said to have injured Zakir’s reputation and caused him to suffer humiliation and ridicule.
“Inflicted Zakir with scandal, odium and untold contempt in the eyes of the public.
“Ridiculed Zakir by creating social and racial tension among Malaysians and thus engineered Zakir to be in a precarious position vis-a-vis his own security.
“Deeply lowered Zakir in the estimation of the right-thinking members of the society,” it added.
Meanwhile, in a Facebook posting, Charles said his lawyers are currently studying the contents to deliberate on possible actions.
